My agency's contract had a $12,000 'administrative fee' buried in section 14, and I only caught it after a client complained
Client called me last month because they were charged $3,500 more than the agreed-upon retainer, and when I dug through the fine print, there it was: a clause that let the agency take a cut of any ad spend over $50k without telling the client. I'm not a lawyer, but apparently that's standard in a lot of these agreements. How do you all handle it when a client finds a fee you didn't even know was in your own contract?
Check whether that fee clause was even in the version your client signed, because agencies sometimes swap in updated boilerplate without flagging it. If your signed copy has the $12k admin fee and the client's doesn't, that changes who eats the cost and whether you can push back on the agency at all. Does your contract spell out who pays for fees the agency adds after signing, or is that part left vague too?
