My cousin who runs a 6 person ad shop in Tampa told me their retainer contracts have no kill fee clause, and now I'm second guessing ours
She handles all the paperwork for their shop and mentioned they had a client walk 3 weeks into a 6 month retainer last month, and they couldn't collect a dime past the work already done. We use the same basic template for our retainer deals, so I brought it up with my partner and he thinks kill fees scare clients off. Anyone here actually enforce a kill fee, or is it mostly just a bluff in the contract?
