Changed my mind about serving subpoenas by mail after a process server in Reno cost us a $12k default
We used to serve demand letters and small claims notices by certified mail to save the $85 per serve, and it worked fine for two years until a client in Sparks got their default judgment thrown out because the signature on the green card didn't match. Opposing counsel pulled the USPS tracking and showed the carrier just left it with a roommate. Now we pay a process server $85 to $110 depending on the county and I don't fight it anymore. Has anyone found a cheaper middle ground that still holds up when a judge actually looks at the proof of service?
Wait, the carrier just handed it to a roommate? That blows my mind. I always figured certified mail meant somebody had to actually sign for it and that was that, end of story. So a random person living there can scribble anything on the green card and now it counts as service? That seems like a huge hole for anyone trying to dodge a lawsuit to crawl through, just have your buddy fake a signature and boom, no case. Twelve grand down the drain over that is rough, I'd be furious. I get why you stopped messing with it.
