My managing partner at our Austin firm said to never put arbitration clauses in client contracts, and after 3 years I think he's flat wrong
I used to draft around arbitration like it was radioactive, but after watching two clients burn $40,000 each on discovery in Travis County last year, I now push for it in almost every retainer and honestly the pushback I get from other associates tells me they're just scared of what they don't understand.
