Good grief, this is the classic runaround and it makes me mad just reading it. Here is my question though: when you signed the delivery note, did the driver actually write down the damage himself, or did you just note it and hand it back? That signed paper is the whole ballgame, because if the driver put it in writing at delivery, the carrier can't just wave it off and tell you to deal with the broker. Also, who did you pay the $850 to, the broker or the carrier directly? That tells you who your actual contract was with, and it changes which one legally owes you.
